The basics

What is Probate?

Probate is the legal process that confirms a Will is valid and authorises the named executor to manage the estate of someone who has passed away: their property, money, debts and possessions. Where no Will exists, the next of kin can apply to become the administrator.

It is not always needed, and the panel below shows when it usually is. If you are unsure, call us. We will tell you honestly whether you need Probate at all, and that call costs nothing.

If you haven't yet made a Will or reviewed your wider estate plan, our estate planning advice guide is a good place to start.

Gathering the estate isn't just property and bank accounts these days, our guide to digital legacy planning covers what executors need to know about online accounts too.

A common question

Do you even need probate?

Not always. A two-minute read of which side you fall on, and if you are unsure, one phone call settles it.

Probate may not be needed

  • The estate is small
  • Everything was owned jointly and passes automatically to the survivor
  • There is no property held in the deceased’s sole name

Probate is usually required

  • The estate includes property
  • Assets were held in the deceased’s sole name
  • A bank or institution asks to see a Grant (thresholds run from £5,000 to £50,000)
